By virtue of an Order of Sale No. CV2015 03 1444 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 20TH DAY

OF APRIL, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Lot Number Seven (7) of the Louis S. Sweitzer's Subdivision of Urlah Sherboady's Farm as recorded in Plat Book 6, Page 64 of Summit County Records. Said part of Lot Number Seven (7) is bounded as follows:

Beginning at a point in the South line of Fess Avenue, 155.30 feet East of the intersection of the South line of Fess Avenue, with the East line of White Avenue; thence Southerly parallel with White Avenue 192 feet; thence Westerly parallel with Fess Avenue, 40 feet; thence Northerly parallel to the Easterly line of White Avenue 192 feet to a point in the Southerly line of Fess Avenue; thence Easterly along the Southerly line of Fess Avenue, 40 feet to the place of beginning. Be the same more or less, but subject to all legal highways.

Deed Reference Number: Dated January 9, 2007, filed January 26, 2007, recorded as Instrument Number 55409110, Summit County, Ohio records.

Property located at: 986 Fess Avenue, Akron, OH 44307.

Property appraised at: Thirty-nine Thousand Dollars ($39,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 4th day of May, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
